Term & Conditions For Product Hire

Hire Of Equipment

1.1. All Products Remain The Property Of Perfectly Planned Events At All Times. We Grant The Hirer A Temporary Bailment Of The Equipment In Exchange For Payment, As Set Out In This Agreement.

Ownership Of The Equipment

1.2. The Hirer Acknowledges That Perfectly Planned Events Retains Full Title To The Equipment During And After The Hire Period. The Hirer’s Right Is Limited To Possession And Use Of The Equipment Under This Agreement.

1.3. The Hire Period Begins On The Agreed Delivery/Collection Date And Ends On The Agreed Return Date, Unless Otherwise Agreed Via Email.

1.4. Equipment Must Be Returned By The Agreed Time And In The Same Condition As Received, Reasonable Wear And Tear Excepted.

1.5. Equipment Will Only Be Confirmed Or Held Once The Deposit Has Been Received In Cleared Funds And A Receipt Has Been Issued Along With Order Confirmation.

1.6. The Hirer Must Provide Safe, Accessible Delivery And Collection Points And Is Responsible For Any Injury, Loss, Or Damage Suffered By Perfectly Planned Events Staff Or Agents At The Delivery Address.

1.7. If Access Is Not Possible, Perfectly Planned Events May Charge Additional Delivery Fees At Its Sole Discretion.

1.8. Perfectly Planned Events Is Not Liable For Injury, Loss, Or Damage Caused By The Hirer’s Use Of The Equipment.

Delivery And Collection Of Equipment If Applicable

2.1. Delivery Fees Are Calculated Per Km/Hour As Outlined In The Quotation. Delivery And Collection Times Are Estimates And Not Guaranteed.

2.2. Perfectly Planned Events Will Make Reasonable Attempts To Set Up Equipment If Specified In The Quotation.

2.3. The Hirer Must Notify Us Of Any Delivery Above Ground Level (E.G., Stairs, Lifts) Before Payment Of The Deposit. Failure To Do So May Result In Additional Fees.

2.4. The Hirer Is Responsible For Ensuring Equipment Dimensions Are Compatible With The Event Space. Perfectly Planned Events May Refuse Delivery If The Equipment Cannot Fit Safely.

2.5. Safe, Clear Access Must Be Provided For Delivery And Collection. Failed Attempts May Incur Additional Charges.

Booking & Payment

3.1. A Booking Is Only Confirmed Upon Receipt Of A Non-Refundable 50% Retainer, Which Cannot Be Transferred Or Used For Credit.

3.2. Prices Are Subject To Change Until The Booking Is Confirmed.

3.3. The Remaining Balance Is Due 14 Business Days Prior To The Commencement Of The Hire Period. Failure To Pay May Result In Cancellation And Loss Of Deposit.

3.4. For Orders Within 7 Days Of The Hire Period, The Full Hire Fee Must Be Paid Within 24 Hours Of Quotation Approval.

3.5. Delivery Will Not Be Confirmed Until All Payments, Including The Hire Fee And Any Delivery Charges, Are Received.

3.6. A Refundable Security Deposit Is Required Before The Hire Period. It May Cover Loss, Damage, Late Returns, Or Cleaning Costs. Any Remaining Balance Will Be Refunded Within 7 Days Of Equipment Inspection.

Hirer’s Responsibilities

4.1. The Hirer Assumes Full Responsibility For Equipment From Collection/Delivery Until Return.

4.2. Equipment Must Be Used Safely, In Accordance With Instructions, And Comply With All Applicable Laws.

4.3. The Hirer Must Not Sell, Charge, Pledge, Or Part With Possession Of The Equipment.

4.4. The Equipment Is At The Hirer’s Risk At All Times.

4.5. The Hirer Is Liable For All Costs Related To Repair Or Replacement Of Damaged Equipment. Assessments Are At Perfectly Planned Events’ Sole Discretion.

4.6. The Hirer Is Responsible For Theft Or Malicious Damage And Must Notify The Police And Provide A Reference Number If Such Incidents Occur.

4.7. The Hirer Must Not Use The Equipment For Illegal Purposes Or In A Manner That Compromises Safety Or Insurance.

Cancellation And Refunds

5.1. Cancellation Must Be Submitted In Writing.

5.2. Cancellation Fees Apply:

• 60+ Days Before Hire Period: Full Refund Of Hire Fee And Deposit.

• 7–59 Days: 40% Non-Refundable.

• Less Than 7 Days: 50% Non-Refundable.

5.3. In The Event Of Bad Weather, Rescheduling Is Allowed Within 3 Months.

5.4. No Refunds Are Given For Early Returns.

5.5. If Perfectly Planned Events Cannot Supply Equipment Due To Previous Hirer Issues, The Hirer Will Receive A Full Refund Of Payments Made.

Limitation Of Liability & Indemnity

6.1. To The Extent Permitted By Law, Perfectly Planned Events’ Liability Is Limited To:

• Resupplying Services, Or Reimbursing Costs To Have Services Resupplied.

• Replacing, Repairing, Or Reimbursing The Cost Of Goods.

6.2. The Hirer Indemnifies Perfectly Planned Events Against Claims, Damages, Or Costs Arising From Use Of The Equipment.

6.3. Perfectly Planned Events Is Not Liable For Indirect, Consequential, Or Special Losses, Including Loss Of Profits, Revenue, Or Substitute Costs.

6.4. Photographs Of Equipment Are For Illustrative Purposes Only; Slight Variations In Colour, Design, Or Dimensions May Occur.

Hirer Covenants

7.1. The Hirer Must Maintain Equipment In Good Condition And Secure It Against Theft, Misuse, Or Environmental Damage.

7.2. Any Damage Must Be Reported Promptly In Writing.

7.3. Repairs Or Maintenance Must Not Be Carried Out Without Written Consent From Perfectly Planned Events.

7.4. Charges May Be Applied To Rectify Damage Arising From Breach Of This Clause.

Collection Of Equipment

8.1. Equipment Must Be Available At The Agreed Time For Collection.

8.2. Failed Collection Attempts May Incur Additional Charges.

8.3. Security Deposits Will Be Refunded Within 7 Business Days, Subject To Inspection And Any Deductions For Loss, Damage, Or Cleaning.

Refusal To Hire

9.1. Perfectly Planned Events Reserves The Right To Refuse Hire To Any Person Or For Any Reason.

Force Majeure

10.1. We Are Not Liable For Delays Or Failure To Deliver Caused By Events Beyond Reasonable Control, Including Natural Disasters, Strikes, Government Restrictions, Or Transport Disruptions.

Governing Law & Jurisdiction

11.1. These Terms Are Governed By The Laws Of South Africa. Any Disputes Arising Will Be Subject To The Exclusive Jurisdiction Of The Courts Of South Africa.

Entire Agreement

12.1. These Terms Constitute The Entire Agreement Between The Hirer And Perfectly Planned Events Regarding The Hire Of Equipment And May Only Be Amended In Writing.

Acceptance

13.1. By Hiring Equipment From Perfectly Planned Events, The Hirer Acknowledges That They Have Read, Understood, And Agreed To These Terms & Conditions.
